RERA possession delay: what compensation can you claim in Pune?

Under-construction residential project in Pune affected by possession delay

Possession delays are one of the most common complaints homebuyers raise against builders in Pune's fast-growing localities. RERA gives buyers a specific, enforceable remedy — but the details matter.

What your agreement promises

The starting point is always your sale agreement, which should specify the promised possession date. RERA project registrations also list this date publicly, which is useful if you've lost track of your own paperwork.

What you can typically claim

  • Interest on amount paid — calculated from the promised possession date until actual possession, at a rate prescribed under RERA rules.
  • A full refund with interest — if you no longer wish to proceed with the purchase due to the delay.
  • Compensation for further loss — in some cases, where the delay has caused additional demonstrable financial harm.

How the claim process works

  1. Gather your agreement, payment receipts, and any builder correspondence about timelines.
  2. Check the project's registered possession date on the MahaRERA portal.
  3. File a complaint with MahaRERA, specifying the relief you're seeking — interest, refund, or both. See our full guide to filing a RERA complaint for the detailed steps.
  4. Attend the scheduled hearing, where both sides present their case.

What if the delay is due to genuine force majeure?

Builders sometimes argue delays were caused by factors outside their control. RERA authorities do consider legitimate force majeure claims, but the burden is on the builder to demonstrate this clearly.

What doesn't count as force majeure

A builder can't claim force majeure for ordinary construction delays or financial difficulties — these are treated as business risks the builder is expected to absorb, not external events beyond their control.

Many buyers wait years before raising a RERA complaint, assuming nothing can be done. In most cases, a complaint can be filed as soon as the promised date has passed.
