For many people dealing with a legal matter for the first time, it's not always clear which court actually handles their case — or when a matter might move from one to the other.
Pune District & Sessions Court
This is where most matters begin. Civil suits, criminal trials, and a wide range of first-instance litigation in and around Pune are heard here, in Shivajinagar. For most people, this is the only court their matter will ever need to reach.
Bombay High Court
The Bombay High Court is Maharashtra's principal court of appeal, and it also has original jurisdiction over certain matters.
What the High Court handles
- Appeals against District Court civil and criminal judgments
- Writ petitions for enforcement of fundamental or legal rights
- Anticipatory bail applications where the Sessions Court has declined relief
- Certain matters of constitutional or jurisdictional significance
When does a matter move from District Court to High Court?
Typically, a matter reaches the High Court only when there's a specific reason to escalate it — an appeal against a District Court decision, a need for a writ remedy the District Court can't grant, or certain bail applications. It's not a routine next step for every case.
Does living in Pune limit you to Pune courts?
No. A Pune-based advocate enrolled with the Bar Council can represent clients before the Bombay High Court, regardless of where in Maharashtra the underlying matter originated. Many Pune residents never need to think about the High Court at all — but for those whose matter does escalate, having continuity with the same advocate across both courts can be a real advantage.
Most people are surprised to learn how few cases actually reach the High Court — it's the exception, not the default next step.
