How to file a RERA complaint against a builder in Pune

Homebuyer reviewing a RERA complaint against a builder in Pune

Pune's real estate market has grown quickly, and so have disputes between homebuyers and builders — particularly around possession delays. The Real Estate (Regulation and Development) Act gives buyers a dedicated forum to raise these complaints: MahaRERA.

What MahaRERA covers

MahaRERA handles complaints relating to registered real estate projects in Maharashtra, including delayed possession, deviation from approved plans, and failure to deliver promised amenities. If your builder registered the project under RERA — which is mandatory for most projects above a certain size — you likely have a route to file here.

When you're eligible to file

  • Possession has been delayed beyond the date promised in your agreement
  • The builder has deviated materially from sanctioned plans or specifications
  • Promised amenities haven't been delivered
  • The builder has diverted funds or misrepresented project details

Step-by-step filing process

  1. Gather your documents. Sale agreement, payment receipts, promised possession date, and any correspondence with the builder.
  2. Check the project's RERA registration. Confirm your project is registered and review its registered timeline on the MahaRERA portal.
  3. Draft the complaint. The complaint should clearly state the agreement terms, what was promised, and how the builder has failed to deliver.
  4. File with MahaRERA. Complaints can be filed online through the MahaRERA portal, along with the prescribed fee.
  5. Attend the hearing. MahaRERA schedules hearings where both parties present their case.

What relief can you get

Depending on the case, relief can include possession with compensation for the delay, interest on amounts paid, or in some cases, a full refund with interest if you no longer wish to proceed with the purchase. If possession delay is your main concern, the compensation rules work a little differently from a standard complaint.

Keep every payment receipt and piece of correspondence with your builder — these become the backbone of a RERA complaint.
